WHEREAS, _____________ County is experiencing considerable growth in population and need for services and public facilities; and,
WHEREAS, _____________ County is in need of additional revenue with which to fund its capital improvement program to meet the needs of its growing citizenry; and,
WHEREAS, a privilege tax on new development is a fair and equitable way to raise funds to meet the demand for additional public facilities;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of _____________ County, Tennessee, meeting in _____________ session on this _____ day of ____________, 20__, in _____________, Tennessee, that the General Assembly of the State of Tennessee is urged to enact a private act to authorize _____________ County to levy a tax on the privilege of constructing new residential and/or commercial buildings, and that payment of this tax will be a condition precedent to the issuance of a building permit; and provided further, that this tax will be levied in an amount per square foot of new residential and/or commercial construction requiring a building permit, up to but not exceeding five dollars ($5.00) per square foot. We ask that the revenue from this tax be collected by the county building commissioner, and that the proceeds be deposited with the county trustee and used exclusively for capital improvements or capital projects, including but not limited to debt service related to such improvements and/or projects, in the general fund, school fund, special revenue funds, debt service fund or other capital project funds as designated by resolution of the board of county commissioners of _____________ County.
BE IT FURTHER RESOLVED, that the county clerk shall send copies of this resolution to the members of the General Assembly representing _____________ County.
