WHEREAS, it is in the best interest of the citizens of ______ County to have solid waste management services other than planning organized as a county department; and,
WHEREAS, Tennessee Code Annotated, Sections 5-19-101 through 5-19-116, and particularly Section 5-19-103, provide various options for counties to utilize in providing garbage collection and other solid waste management services; and,
WHEREAS, the general law options for providing garbage collection and other solid waste management services authorizes ________ County to establish a sanitation department headed by a superintendent appointed by the county executive, subject to confirmation by the county legislative body;
NOW THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of ________ County, Tennessee, meeting in session at ________ on this _________ day of , 20___, as follows:
1. A Sanitation Department shall be established for ________ County pursuant to T.C.A. § 5-19-101, et seq.
2. The said Sanitation Department shall be headed by a superintendent appointed by the county executive of ________ County subject to the approval of the Board of County Commissioners of ________ County. The said superintendent shall serve at the pleasure of the county executive. The annual salary of the superintendent shall be $ , payable monthly from the Fund.

The Sanitation Department and the department’s superintendent shall exercise the powers granted to them by the general law and shall perform all non-planning services relating to garbage collection and solid waste management which the county provides. These services shall be performed in a manner consistent with the approved municipal solid waste management plan for ________ County.
4. The Sanitation Department created by this resolution shall begin operations upon the confirmation of its superintendent by the Board of County Commissioners, and shall thereupon have custody of county assets allocated to the solid waste management function.

The Sanitation Department and the department’s superintendent shall exercise the powers granted to them by the general law and shall perform all non-planning services relating to garbage collection and solid waste management which the county provides. These services shall be performed in a manner consistent with the approved municipal solid waste management plan for ________ County.
